Please read these terms carefully before creating custom songs, uploading memories, or purchasing digital studio masters.
Acceptance of Terms
These Terms of Use ("Terms") constitute a legally binding agreement between you and Melody Gift Ltd. ("MelodyGift", "Company", "we", "us"), governing your access to and use of our website, AI music studio creation modal, private recipient gift pages, and related services ("Services").
By accessing our platform or purchasing any custom audio product, you confirm that you are at least 18 years of age (or have reached the legal age of majority in your jurisdiction) and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must immediately discontinue use of the Services.
MelodyGift Studio Services
MelodyGift operates an emotional AI platform designed to convert customer-submitted stories, memories, inside jokes, and lyrics into studio-grade custom audio recordings and interactive digital keepsakes.
Free Audio Preview Demo
Allows users to create a ~30-second AI preview demo free of charge without entering credit card details.
Full Studio Master ($19)
Unlocks full 2–3 minute studio song, 2 style variants, 320kbps MP3 download, printable PDF lyrics, and dedicated shareable URL.
Pricing & Payments
All payment transactions are processed securely through Stripe Payments. Prices are displayed in US Dollars ($) or designated local currency and are charged as a one-time non-recurring fee upon checkout.
You represent and warrant that you have the legal right to use any credit card or payment method utilized in connection with any transaction.
Intellectual Property & Hybrid License
MelodyGift operates under a Hybrid Licensing Model governing custom AI-generated songs and lyrics:
A. Standard Personal License ($19 Purchase)
Upon full payment of the $19 Master fee, Melody Gift Ltd. grants you a perpetual, worldwide, non-exclusive, royalty-free license to use, download, play, perform, and share the generated custom song and lyrics for personal, non-commercial purposes (e.g., gifting to loved ones, wedding receptions, personal social media posts, home video sync).
B. Commercial Use Rights
Standard purchases do not include commercial distribution rights (such as monetized Spotify/Apple Music streaming, commercial advertisements, TV/film synchronization, or reselling). Commercial licensing agreements are available upon written request to support@melody.gift.
User Content & Submissions
You retain ownership of any text prompts, stories, inside jokes, and photos you upload to our Services ("User Content"). By submitting User Content, you grant Melody Gift Ltd. a limited, non-exclusive license to use, process, and display such content solely to compose, generate, host, and deliver your requested audio products and custom digital gift pages.
You guarantee that you own or have obtained all necessary permissions, privacy releases, and rights from third parties (including gift recipients) to submit their names, stories, and likenesses to our Services.
Prohibited Conduct
You agree not to submit any User Content or use the Services in a manner that:
- Is defamatory, obscene, pornographic, hateful, or incites violence.
- Infringes upon any third party’s copyright, trademark, privacy, or publicity rights.
- Impersonates any real celebrity or public figure without authorization.
- Attempts to reverse-engineer, scrape, or overload our AI synthesis servers.
We reserve the right to cancel orders and terminate access for any user violating these content standards without refund.
AI Audio Generation Disclaimer
MelodyGift utilizes advanced artificial intelligence models to synthesize studio arrangements and vocals based on your prompts. Due to the generative nature of AI, slight variations in vocal inflection, pronunciation of rare names, or musical composition may occur.
We provide multiple style variants and a 100% satisfaction guarantee to ensure you receive a gift you love.
Limitation of Liability
To the maximum extent permitted by applicable law in Bulgaria and the EU, Melody Gift Ltd. shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of or inability to use the Services.
In no event shall our total aggregate liability exceed the total amount paid by you to Melody Gift Ltd. in the twelve (12) months preceding the claim.
Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Bulgaria and applicable European Union legislation, without giving effect to conflicts of law principles.
Any disputes arising under or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Bulgaria.
